Key Updates to the NSW Work Health and Safety Regulation 2025
On 22 August 2025, the Work Health and Safety Regulation 2025 came into effect in New South Wales. While much of the 2017 framework remains, several important updates have been introduced that organisations should be across:
Psychosocial risks
Strengthened requirements now apply, with duty holders expected to manage psychosocial risks using the established hierarchy of controls. This elevates psychosocial hazards to the same level of structured risk management as physical hazards.
Compliance and enforcement
New penalty notice offences have been added under Schedule 18A, expanding SafeWork NSW’s compliance toolkit. Businesses should review these to understand their obligations and potential exposures.
Training authorisations
SafeWork NSW is now empowered to authorise training providers and courses, with associated fees applying. This change is intended to ensure consistency and quality in accredited training.
Emergency planning
Sites holding 25,000 kg or more of lithium batteries must now lodge an emergency plan with Fire and Rescue NSW. This reflects the growing recognition of fire and explosion risks linked to large-scale energy storage.
Silica Worker Register
A new Silica Worker Register will commence on 1 October 2025, requiring records of workers undertaking high-risk silica work.
